Fire safety in commercial buildings: a new unified framework with Decree No. 2025-1100 of 19 November 2025

Decree No. 2025-1100 of 19 November 2025 overhauls the fire safety framework applicable to commercial buildings.


It specifies the conditions for using equivalent solutions, which must be justified by a fire safety engineering study demonstrating a level of protection at least equivalent to the required standards.


The text then transfers the rules from the Labour Code to the Building and Housing Code, to create a single, coherent legal framework.


At the same time, the requirement to apply for a fire safety opening permit has been removed for 5th category public buildings without sleeping quarters.


Chapter IV of the Building and Housing Code now sets out the technical requirements for ventilation, evacuation, smoke extraction, lighting, alarms and emergency access.


The text also provides for the creation of protected areas for people who are unable to evacuate.


However, certain obligations will only apply to buildings whose top floor is more than 8 metres above ground level.


Implementation will be gradual: 21 November 2025, 1 July 2026, then 1 January 2027 for full transfer.
